Para
8 :
This para grants power to the Government to prohibit
foreigners from visiting certain notified places like
border areas.
Para
9 :
This para grants similar power in respect of exclusion
from visits by foreigners of certain protected areas.
Para
10 :
This para places restriction on employment in certain
undertakings by foreigners during their stay in India.
It provides as under :
Restrictions
on employment
- No foreigner
shall, without the permission in writing of the civil
authority, either enter any premises relating to,
or accept employment in, or in connection with
- any
undertaking for the supply to Government or to the
public of light, petroleum, power or water, or
- any
other undertaking which may be specified by the Central
Government in this behalf.
- As can
be seen from the above, the restrictions on employment
only apply in respect of certain strategic areas of
employment in undertakings which could be said to
be vital to national security etc.
B.
- THE
PASSPORT (ENTRY INTO INDIA) ACT, 1920
This
Act confers on the Central Government powers to
make rules requiring possession of passports by
persons entering India. Under Section 3 of the Act,
the Central Government may make Rules requiring
that persons entering India shall be in possession
of passports, and for all matters ancillary or incidental
to that purpose, and also provides for fines, penalties
for contravention thereof.
- THE
PASSPORT (ENTRY INTO INDIA) RULES, 1950
In
terms of Section 3 of the Passport (Entry into India)
Act, 1920, the Central Government made the above
Rules, requiring a person proceeding from any place
outside India to enter India, only if he is in possession
of a valid passport. Rule 5 specifies the conditions
of a valid passport to be the following
that
it should have been issued or renewed by or on behalf
of the Government of the country of which the person
to whom it relates, is a national, and shall be
within the period of its validity.
that
it should also have been endorsed by a proper Indian
or Diplomatic consular or passport authority by
way of visa for India for such period as may be
specified therein.

- THE
REGISTRATION OF FOREIGNERS ACT, 1939
This
Act was enacted by the Central Government in 1939
to make regulations for the registration of foreigners
entering into and staying in India. Under Section
3 of the Act, the Central Government may, by notification
in the official Gazette, make Rules with respect
to foreigners for all or any of the following purposes
:
- For
requiring any foreigner entering, or being present
in India to report his presence to a prescribed
authority within such time and in such manner
and with such particulars as may be prescribed
;
- For
requiring any foreigner moving from one place
to another place in India to report, on arrival
at such other place his presence to a prescribed
authority, within such time and in such manner,
and with such particulars as may be prescribed
;
- For
requiring any foreigner who is about to leave
India to report the date of his intended departure
and such other particulars as may be prescribed
to such authority etc.
- For
requiring any foreigner entering, or being present
in India, to furnish proof of his identity ;
- For
requiring hotel managements etc. to furnish particulars
re. foreigners residing in hotel premises to a
prescribed authority ;
- For
requiring persons having management and control
of vessel or aircraft to furnish to a prescribed
authority, information re any foreigner entering
or intending to depart from India ; etc.
