  • THE REGISTRATION OF FOREIGNERS RULES , 1992

    In exercise of the powers conferred by Section 3 of the Registration of Foreigner’s Act, 1939, the Central Government made the Registration of Foreigners Rules, which came into force on July 1st, 1939. These Rules were amended by Registration of Foreigners Rules, 1992 which came into force with effect from March, 19, 1992
    .
    Under the provisions of these Rules, the Central Government has appointed Registration Officers (prescribed authorities) in order to carry out the functions and supervision of registration of foreigners.

    These officers have further been delegated powers to appoint other authorities to carry out functions under these Rules, at other places.

    These Rules require every foreigner who arrives in India on board any vessel, to furnish true particulars of his name, nationality, age, sex, place of birth and address or intended address in India, purpose of visit and proposed length of stay in India.

    A foreigner entering India on a visa valid for a period exceeding 180 days, and also a foreigner staying in excess of 180 days after extension of visa, is bound to present in person to the appropriate Registration Officer a report containing a true statement of the foreigner’s address in India and other particulars as prescribed.

    The Registration Report is to be presented in person to the Registration Officer specified in this behalf by the Registration Officer of the port or other place of arrival in India. This Report is to be furnished within the time allowed in this behalf, as under :
  • in the case of a person with visa valid for a period upto 180 days but he wishes to stay beyond 180 days, at least 60 days before the expiry of his visa ;
  • in the case of person with visa for a period beyond 180 days, within 2 weeks of his arrival in India ;
  • Every foreigner presenting a Registration Report shall furnish to the Registration Officer such information as may be in his possession to establish accuracy of the particulars stated by him, and to sign the aforesaid document, and thereafter would be entitled to receive from the said officer a ‘Certificate of Registration’.

    As such, under provisions of these Rules as stated above, a foreigner is required to inform the Registration Officer of his presence in India and obtain a Certificate of Registration from that officer under Rule 6. He is further required to surrender his Certificate of Registration immediately before his final departure from India in accordance with Rule 15 and obtain an endorsement from the Registration Officer to that effect.

    The purpose for which the Certificate of Registration is issued in respect of a foreigner is to regulate his movements within the district in which the registration certificate was granted, and also to restrict his stay within the period specified in the visa issued to him.

    Under these Rules, the foreigner is also required to inform the registration authorities in writing in case he proposed to remain absent from his registered address for a continuous period of eight weeks or more.
