  • FORMALITIES TO BE COMPLETED ON ARRIVAL AND STAY IN INDIA
    • Formalities on Arrival :

Immediately on arrival in India by an international carrier, e.g. aircraft etc., the foreigner is required to fill up a form stating personal particulars and purpose of visit. This prescribed form is required to be submitted to the concerned immigration officer at the airport of arrival.

    • Registration Formalities for stay in India :

The authorities have waived the requirement of registration in respect of a foreigner who enters India on a visa valid upto 180 days and who does not remain in India beyond 180 days.

Foreign snationals arriving in India with visa for a period more than 180 days, are required to register themselves with the concerned Foreigners Regional Registration Officer (FRRO) in the district/city in which the foreigner is to reside in India. Registration with FRRO in such cases is necessary even if the foreigner’s stay is likely to be of a shorter period of say one or two months. Application for such registration is to be made by the applicant in person to the FRRO office, in the prescribed form. Upon verification of the particulars, FRRO gives a Certificate of Registration (RC) or a Residential Permit (RP) to the concerned applicant, mentioning therein the period for which such registration/period of stay has been granted.

In smaller cities and towns where no FRRO office exists, registration formalities and powers have been delegated to the police authorities of the district where the foreigner resides. In such cases, the Superintendent of Police (SP) of the concerned district/city is empowered for all registration related formalities.

Upon furnishing the application for registration, FRRO scrutinizes the application and other particulars of the intending registree, and, on being satisfied, grants a Residential Permit (RP)/Certificate of Registration (RC) to the concerned foreigner. The RP/RC permission is given in the hand-book filled up alongwith Registration Form, and mentions the period upto which the foreigner has been allowed to stay in India. An endorsement to this effect is also made on the foreigner’s passport.

The purpose of such registration is to keep the local authorities informed of the presence, period of stay and local address of the foreigner.

    • Formalities for extension of stay in India :

All foreigners holding visas only upto 180 days, and desiring to stay in India beyond 180 days can seek extension for the intended period
of stay by making application to FRRO in prescribed form. (In these cases, the concerned FRRO authorities after being satisfied can grant extension of visa for a period upto 6 months. In case the visa desired is of a period exceeding six months, then the concerned FRRO authorities seek permission of the Ministry of Home Affairs (MHA) in New Delhi, who allow extension of desired stay on being satisfied about the purpose and need. To satisfy the authorities about the nature of activity to be carried on, authorities may require production of some of the following documents :

  1. Copy of the Agreement between the Foreign Company (Employer) and the Indian
    Company under which services of foreign national are being deputed ;
  2. Copy of approval of Government of India or the Reserve Bank of India to the above Agreement ;
  3. Confirmation of the employer that services of the foreign national are being provided under the Agreement with the Indian Company for the execution of work in India ;
  4. Recommendation from the Indian Company ;
  5. A confirmation that the Indian company takes full responsibility for the conduct of the foreign national ;
  6. Permission granted to foreign employer, if operating in its own name, by the Reserve Bank of India.
