The
local authorities, as per our experience, normally grant
Residential Permits, only for a maximum period of six
months from the expiry of visa at a time. As such, if
the stay of foreign national exceeds a period of six
months, it is necessary to secure renewal of the Permit,
before expiry of the permit. At this time, the Ministry
of Home Affairs investigates the need for continued
presence in India of the foreign national and on being
satisfied, grants extension of permit.
At
the time of grant of extension of stay, requests for
MEV facility are also considered. MEV facility is granted
on the satisfaction of the authorities.
It
is necessary that the family members of foreign national
who are accompanying him, should also comply with necessary
formalities for Residential Permit and seek registration
with local authorities.
- Departures
for visits abroad :
For
holders of visa with MEV facility, no formalities (excepting
filling up Immigration Card at airport) are required
for any number of visits abroad.
In
case visa has been obtained without MEV facility, foreigner
has to obtain fresh visa for re-entry into India.
- FORMALITIES
TO BE COMPLETED BEFORE FINAL DEPARTURE FROM INDIA
In
the case of final departure from India of a foreign
national, the foreigner is required to surrender the
registration papers at the port of departure.

SPECIAL CONCESSIONS GRANTED BY REGISTRATION AUTHORITIES
Sometimes,
considering the nature of work, location of project
and number of foreign nationals expected to arrive,
special facilities/exemptions are granted by the concerned
authorities to facilitate the compliance of the requirements.
In
such cases, it is advisable to seek special exemption
in respect of registration formalities with the concerned
authorities. The facilities granted are of the following
nature :
- Issue
of general instructions for grant of multi-entry
visa facility for all foreign nationals deputed
on such project, from time to time ;
- Exemption
from necessity to submit registration papers to
immigration authorities for short visits abroad
;
- Exemption
from requirement for personal appearance of foreign
national before registration authorities for seeking
extension of stay/exit permit etc.
In
our view, in cases where numerous foreign nationals
propose to visit India for major projects, it is advisable
to approach the concerned authorities, in New Delhi
to explore possibilities of obtaining suitable concessions
in connection with compliance of these formalities.
